The Utah Solid and Hazardous Waste Control Board is proposing to enter into a STIPULATION AND CONSENT ORDER (number 0606024) with Oil Re-Refining Company, Inc. (ORRCO), a used oil marketer, transporter and transfer facility located at 977 South 700 West, Salt Lake City, Utah. The proposed STIPULATION AND CONSENT ORDER will resolve the Notice of Violation (number 0609034) concerning violations by ORRCO of its used oil permit and the Used Oil Management Rules.
A thirty-day (30 day) public comment period regarding the proposed STIPULATION AND CONSENT ORDER will begin on Monday, March 5, 2007 and end on Tuesday, April 3, 2007. AIR QUALITY
Kennecott Utah Copper Corporation (KUCC) has requested to modify the fuel requirements in the current Power Plant Approval Order (AO) DAQE-AN0572016-05. Currently KUCC is required to test the power plant if natural gas is used as a fuel during the winter months. The PM10 State Implementation Plan (SIP) does not require KUCC to perform a test if they perform start-up, maintenance and break-in firings during the winter months and use natural gas as a fuel. KUCC has requested that the language for the SIP be implemented into the AO.
Salt Lake County is a Non-attainment area of the National Ambient Air Quality Standards (NAAQS) for PM10 and SO2, and is a Maintenance area for Ozone. Title V of the 1990 Clean Air Act applies to this source. The requirements for the Title V shall be followed until operating permit for this source has been amended. There will be no change in the emission limits or rates from this AO modification
The completed engineering evaluation and air quality impact analysis showed that the proposed project meets the requirements of federal air quality regulations and the State air quality rules. Approval is recommended.

AIR QUALITY
PacifiCorp has submitted a Notice of Intent (NOI) to replace and install new emissions control equipment (replace the electrostatic precipitator with a fabric filter, upgrade a flue gas desulfurization system, and install new low-NOx burners and an overfire air systems) at Units 1, 2 and 3 of the Hunter Power Plant. These changes will result in substantial emission reductions of sulfur dioxide (SO2), particulate matter (PM) and nitrogen oxides (NOx) and possibly increase in CO emissions at the plant. In addition, the Company is requesting plant-wide applicability limits (PALs) for SO2 and NOx emissions. Also, opacity language for the Unit #1, #2, and #3 boilers stacks was expanded and to clarify opacity limit during the startup and shutdown periods.
The source will be located in Emery County, near the Castle Dale Utah. Emery County is an Attainment area of the National Ambient Air Quality Standards (NAAQS) for all pollutants. There will be no violations of the NAAQS resulting from this project.
New Source Performance Standards (NSPS) regulations apply to this source, but no changes in these requirements will result from the modifications. Title V and title IV the 1990 Clean Air Act apply to this source, and the Title V Operating Permit will be updated prior to operation of the new or modified control equipment.
The source has existing limitations for the plant that are established in PacifiCorp’s existing Approval Order (AO) (DAQE-1189-97.dated December 18, 1997, Unit #1 dated April 3, 1986, Unit #2 dated July 27, 1987, Unit #3 dated August 31, 1893 and additional letters dated October 27, 1983 and September 6, 1985.).
While the equipment list will also be updated, the only change in limitations at the plant will be as follows:
Emissions of SO2 from Units #1 and #2 boilers shall be no greater than 0.12 lb SO2/MMBtu heat input based on 30-day rolling average period
PacifiCorp shall use a continuous monitoring system for measuring sulfur dioxide emissions.
Emissions of NOx shall be no grater then 0.26 lb/MMBtu heat input for any 30-day rolling period from Units #1 and #2 boilers and shall be no greater than 0.34 lb/MMBtu heat input for any 30-day rolling period from Unit # 3 boiler.
PacifiCorp shall use a continuous monitoring system for measuring nitrogen oxides emissions.
Emissions of particulate matter (filterable) from Unit # 1 and # 2 boilers (PM10) shall be no greater then 0.015 lb/MMBtu heat input based on 3 test run average.
Emissions of CO Unit # 1, # 2and # 3 boilers shall be no greater than 0.20 lb/MMBtu heat input based on 3 test run average.
After the installation and upgrades of the control equipment, the emissions from the plant, in tons per year, will change as follows: PM10 = (-) 1,441.02, NOx = (-) 8,754.5, SO2 = (-) 4,080.6, CO = (+) 11,328. H2SO4 = (-) 33.1, HFl = (-) 7.5, and HCl = (-) 27.9.
The change in emissions, as a result of the PAL limits, addition and upgrades of control equipment, will result in the following, in tons per year, potential to emit totals for the plant: PM10 = 1,218.1, NOx = 19,862.5, SO2 = 6,715.5, CO = 12,536, VOC = 163, H2SO4 = 3.5, HF = 44.6, HCl = 13.41 (HAP), Lead = 0.12, other HAPs = 43.15.
Established PALs for NOx = 19,862.5 and SO2 = 6,715.5 based on 12-month rolling average.
The calculated impact of this source on air quality is as follows:

The Executive Secretary of the Utah Solid and Hazardous Waste Control Board invites comment from the public regarding closure plans for Hazardous Waste Management Units (HWMU) 9, 55 and 58 at U.S. Army Dugway Proving Ground (Dugway). HWMU 9 is an abandoned hazardous waste storage area, HWMU 55 is a landfill that was used for disposal of waste including chemical agent related materials and munitions and HWMU 58 is an abandoned pond that was used for disposal of chemical agent decontamination solutions and industrial wastewater. All three HWMUs, and all releases of contamination from these HWMUs, are located within the Dugway boundary.
The plans for closure of these sites are based on soil and groundwater samples, and other data collected at each site, and the requirements of R315-7-14 and R315-101. The investigation data was used to define the nature and extent of contamination at each site and complete risk assessments and natural resource evaluations. These assessments and evaluations conclude that additional closure action is needed at each site. Dugway has proposed to close HWMU 9 by removing the waste and contaminated soil. HWMUs 55 and 58 will be closed as landfills with the placement of soil covers. Long-term groundwater monitoring and site management will also be needed.

The source will be located in Grand County, accessed via the town of Harley Dome. Grand County is an Attainment area of the National Ambient Air Quality Standards (NAAQS) for all pollutants. There will be no violations of the NAAQS resulting from this project.
New Source Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants (NESHAP), Maximum Achievable Control Technology (MACT) regulations, and Title V of the 1990 Clean Air Act do not apply to this source. This source does not require a Title V operating permit.

Snow College has submitted a Notice of Intent (NOI) to construct and operate one natural gas fired boiler as a backup to the two larger dual fuel boilers. The new boiler will be rated at 21 MMBtu/hr and it will be operated during the months when the campus load is low. The source wide natural gas consumption limit will remain the same. Therefore, the emissions, in tons per year (tpy), will not change as a result of the addition of the new boiler and potential to emit totals will remain at the same levels of: PM10 = 1.02, NOx = 8.05, SO2 = 11.24, CO = 5.87 and VOC = 0.54.

SOLID AND HAZARDOUS WASTE
Wasatch Regional Landfill Inc. has submitted a modified design for the final cover of their Class V landfill located on the west side of county road #128 approximately six miles north of Interstate 80 in Tooele County. The modification proposes the use of an evapotranspiration final cover designed to minimize the amount of moisture that can move through the final cover and into the waste. The proposed design incorporates the use of onsite soil with adequate thickness to ensure the precipitation either runs off the final cover or provides adequate storage capacity so that the moisture is returned to the atmosphere by evaporation or plant transpiration. The proposed design will result in an infiltration rate of less than 3 millimeter per year.
The proposed modification has been reviewed and determined it to be complete and in compliance with the Utah Solid Waste Permitting and Management Rules. The public comment period for the modification begins on March 8, 2007 and ends April 9, 2007. A public hearing may be held if, within 15 days of the publication date of this notice, a request is made to the Executive Secretary in writing and meets the requirements of Utah Administrative Code R315-311-3.

SOLID AND HAZARDOUS WASTE
The Executive Secretary of the Utah Solid and Hazardous Waste Control Board invites comment from the public regarding cleanup proposals for Solid Waste Management Units (SWMU) 18, 19, 23, 25, 115, 118, 180, 188, 197, 199 and 212 at U.S. Army Dugway Proving Ground (Dugway). The sites range in size from less than an acre to over 20 acres, and were used for disposal of a variety of waste. All SWMUs are located within the Dugway boundary.
The cleanup proposals are based on soil and groundwater that was used to define the nature and extent of contamination, conduct human health and ecological risk assessments, and evaluate potential natural resource damage. The cleanup proposals indicate these SWMUs currently pose an unacceptable risk for any land use. The proposals also include an evaluation of cleanup alternatives. The cleanup alternative chosen for these SWMUs is excavation of waste and contaminated soil at SWMUs 18, 19, 23, 25, 115, 118, 180, 188, 199 and 212; and a landfill cover for SWMU 197. Revised risk assessments and other evaluations will be provided after the removal actions to determine final land use. The SWMUs can be cleaned so no further action is required, or so long-term groundwater monitoring and site maintenance are required.

Asphalt Materials operates an asphalt plant and an asphalt recycling plant located at 7961 South 1300 West in West Jordan, Salt Lake County, a nonattainment area for PM10 and SO2. New Source Performance Standards (NSPS) 40 CFR 60.90 to 60.93 (Standards of Performance for Hot Mix Asphalt Facilities), and Subpart OOO, 40 CFR 60.670 to 60.676 (Standards of Performance for Nonmetallic Mineral Processing Plants) apply to this installation. National Emission Standards for Hazardous Air Pollutants (NESHAP) and Maximum Available Control Technology (MACT) regulations do not apply to this source. Title V of the 1990 Clean Air Act applies to this source.
The source has proposed to increase production for the Recycle Plant from 50,000 tons per year to 400,000 tons per year. The materials processed at the Recycle Plant shall include recycled asphalt, Portland cement concrete, roadbase top soil, sand, gravel or other screenable materials. There will be 4.05 tpy emission increases in PM10. The changes in emissions will result in the following, in tons per year, potential to emit totals: PM10 = 27.91, NOx = 8.49, SO2 = 2.36, CO = 31.31, VOC = 5.67 and HAPs (aldehydes) = 1.01

Simplot Phosphates LLC has petitioned the Utah Solid and Hazardous Waste Control Board to renew Permit #9908 to operate a Class IIIb landfill. This landfill, called the Simplot Phosphates Landfill, is permitted to dispose of nonhazardous industrial wastes generated by phosphate mining and milling and includes incidental office wastes, shipping wastes, and incidental wastes generated by meals. The landfill is located approximately 10 miles north of Vernal on Highway 191. The Utah Solid and Hazardous Waste Control Board grants operating permits for ten years. The permit renewal application and subsequent response to additional information requested by the Division of Solid and Hazardous Waste (DSHW) have been reviewed and found to be complete and a draft renewal permit has been prepared.

An emergency hazardous waste treatment permit (UT-008-2007) has been issued to the Ensign-Bickford Company (EBCo) by the Executive Secretary of the Utah Solid and Hazardous Waste Control Board. The permit allowed EBCo personnel to treat by open burning, Building 16 and QC Test Shed. During many years of past operations, explosive products were stored, processed, or handled in Building 16 and the Test Shed. The building structures may have been contaminated with explosive residues. Utah Administrative Rules allow for application of an emergency permit if an imminent and substantial endangerment to human health or the environment is present. Due to the explosive and safety hazard present, the Permittee requested the ability to deactivate the potential explosive residues in or on building structures through thermal treatment. The treatment is necessary to facilitate off-site disposal of building debris or structures in approved landfills.
