SOLID AND HAZARDOUS WASTE

The Executive Secretary of the Utah Solid and Hazardous Waste Control Board will hold a hearing on October 2, 2007 to receive comment on two site-specific variances requested by EnergySolutions LLC at 6:00 p.m. at the Tooele County Courthouse.
a) The first variance is to receive waste containing osmium tetroxide (P087). The required treatment methods for this waste are either RMETL or RTHRM. Each of these methods is designed to recover the osmium metal for recycling. Due to the radioactive nature of this waste, reuse of osmium is not possible. EnergySolutions is proposing to grout the waste in a cement mixture, then isolate the resulting monolith with its macroencapsulation process, and then dispose of the waste in the Mixed Waste Landfill Cell.
b) The second variance is to receive 11 cubic feet of waste containing lead contamination (D008) and also containing Polychlorinated Biphenyls (PCBs) as Underlying Hazardous Constituents. Through treatability studies performed at the site, EnergySolutions has confirmed successful treatment below the treatment standards for all contaminants except PCBs. The PCB treatment standard is not attainable using their current chemical treatment technologies. Following treatment of the lead, final disposal of the waste will occur in the Mixed Waste Landfill Cell.

SOLID AND HAZARDOUS WASTE

The Deseret Chemical Depot (DCD) will hold a public information meeting on October 3, 2007, at the Tooele Chemical Stockpile Public Outreach Office at 6:00 p.m. for a Class 2 Modification (07.02728) to its Tooele Chemical Agent Disposal Facility (TOCDF) permit. The DCD installed a high-speed fire suppression deluge system directly above the Miscellaneous Parts Removal Station (MPRS) Conveyor to reduce an associated fire hazard when punching multiple holes into booster canisters, which resulted in a wide dispersion of explosive powder onto the conveyor and surrounding surfaces. The deluge piping no longer serves a useful purpose since no munitions remain in the DCD stockpile that possess boosters. In order to eliminate maintenance of the obsolete system and the inherent potential for spurious or inadvertent actuation, TOCDF intends to remove the piping system through this modification.

Cerro Flow Products, Inc. (Cerro) has requested a modification to their Approval Order DAQE-750-01, dated September 11, 2001, for various changes. They will be removing equipment and adding new equipment. The added equipment will be part of their new manufacturing line to produce copper tubing with internal grooves. Cerrro currently operates the copper tube manufacturing plant in Cedar City, Utah.

Cedar City, which is located in Iron County, is an attainment area of the National Ambient Air Quality Standards (NAAQS) for all pollutants. New Source Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants (NESHAP) and Maximum Achievable Control Technology (MACT) regulations do not apply to this source. Title V of the 1990 Clean Air Act does not apply to this source.

The source has limitations that are established in the Intent to Approve. Visible emissions are controlled by opacity standards set in the ITA.

The emissions, in tons per year, will remain the same potential to emit totals: PM10 = 5.56, NOx = 9.77, SO2 = 0.25, CO = 6.26, VOC = 25.05, HAPs = 2.63

The completed engineering evaluation and air quality impact analysis showed that the proposed project meets the requirements of federal air quality regulations and the State air quality rules. Approval is recommended.

New Source Performance Standards (NSPS) apply to this source (40 CFR 60 Subpart A and Subpart OOO). This plant would emit all air pollutants at the rate of less than 100 tons per year.

The engineering evaluation has been completed and the project would not result in adverse air quality impacts. It is the intent of the Executive Secretary to approve the project.

The source can operate at various locations throughout the State of Utah. There will be no violations of the NAAQS resulting from this project.

New Source Performance Standards (NSPS) 40 CFR 60 Subparts OOO regulations apply to this source. National Emission Standards for Hazardous Air Pollutants (NESHAP) and Maximum Available Control Technology (MACT) regulations do not apply to this source. Title V of the 1990 Clean Air Act applies to this source.

Chevron Products Company is requesting a reissue of a UPDES Permit. Chevron refinery is approximately 60 years old and currently processes an average of about 15 million barrels of oil per year. The wastewater treatment system currently consists of a wastewater collection box, settle vessel, three surge tanks, an induced air flotation unit, two equalization tanks, ten submerged biological contactors, eight rotating biological contractors, two clarifiers, and aerobic sludge digester, and an effluent weir box.

Garkane Energy Warehouse (Garkane) has submitted a notice of intent to operate a portable diesel generator set consisting of a generator, a diesel storage tank and a trailer-mounted transformer at its Todd Substation in Kane County. Garkane intends to operate the generator set primarily at the Todd Substation, but may temporarily move it to other locations. Garkane will be permitted to operate for a maximum of 1,000 hours per year at each location.

The source will primarily be located in Kane County, which is an attainment area of the National Ambient Air Quality Standards (NAAQS) for all pollutants. There will be no violations of the NAAQS resulting from this project.

New Source Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants (NESHAP) and Maximum Achievable Control Technology (MACT) do not apply to this source. Title V of the 1990 Clean Air Act does not apply to this source.

ATK operates a rocket motor manufacturing plant, located 28 miles west of Brigham City, on US Highway 83, Box Elder County. ATK is requesting that the asbestos room in their Process Control Laboratory at building M-585 be removed from their Approval Order and Title V permit. The two HEPA filter systems associated with the asbestos room will be removed.

Box Elder County is an attainment area of the National Ambient Air Quality Standards (NAAQS) for all pollutants. New Source Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants (NESHAP) and Maximum Available Control Technology (MACT) regulations apply to this source but not to this modification. Title V of the 1990 Clean Air Act applies to this source. There will be no change in the allowable emissions. The allowable potential to emit emissions, in tons per year, are as follows: PM10 = 187.24, VOC = 75.00, and HAPs = 70.00.

Rees’s Enterprise has requested to modify Approval Order (AO) DAQE-AN1878005-06 to add two crushers and two screens. Schmidt Construction Company has submitted a Notice of Intent (NOI) to modify a condition of their current AO DAQE-AN-132690001-07 in Cedar City, Utah.

The source will be located in Iron County, near the city of Cedar City, Utah. Iron County is an attainment area of the National Ambient Air Quality Standards (NAAQS) for all pollutants. There will be no violations of the NAAQS resulting from this project.

New Source Performance Standards (NSPS) 40 CFR 60 - Subparts A (General Conditions) and OOO (Standards of Performance for Non-metallic Mineral Processing Plants) apply to this source. National Emission Standards for Hazardous Air Pollutants (NESHAP) and Maximum Available Control Technology (MACT) regulations do not apply to this source. Title V of the 1990 Clean Air Act applies to this source.

The source has limitations that are established in the Intent to Approve. Visible emissions are controlled by opacity standards set in the ITA. Some of the limitations that are listed in the ITA are included in this newspaper notice and are as follows:

• 4,000 tons of crushed aggregate products haul offsite per day

• 10,000 tons of crushed aggregate products haul offsite per day if the surfactant has been applied to the haul-road surfaces within the previous two weeks

• 10 hours of operation per day between 6 A.M. and 7:00 P.M.

• 103,000 gallons of diesel fuel consumed per rolling 12-month period

Visible emissions limitations:

A. All crushers - 15% opacity
B. All screens - 10% opacity
C. All conveyor transfer points - 10% opacity
D. All diesel engines - 20% opacity
E. Conveyor drop points - 20% opacity
F. All Storage Piles - 20% opacity
G. All other points - 20% opacity

The potential to emit totals, in tons per year, will remain the same as follows:: PM10 = 8.09 (fugitives = 7.28), NOx = 19.71, SO2 = 2.59, CO = 5.68, VOC = 1.37, Aldehydes = insignificant.

The PacifiCorp-Trail Mountain Mine facility was an active underground coal mine which previously extracted approximately 2 million tons per year before ceasing operations in 2001. Running Foxes Petroleum, Inc. has submitted a Notice of Intent (NOI) to construct and operate a natural gas processing plant.

The source will be located in Grand County, roughly three miles northeast of the town of Cisco. Grand County is an Attainment area of the National Ambient Air Quality Standards (NAAQS) for all pollutants. There will be no violations of the NAAQS resulting from this project.

New Source Performance Standards (NSPS) apply to this source (40 CFR 60 Subpart A and Subpart KKK). National Emission Standards for Hazardous Air Pollutants (NESHAP) and Maximum Achievable Control Technology (MACT) regulations do not apply to this source. Title V of the 1990 Clean Air Act applies to this source. This area source does not require a Title V operating permit.

The source has limitations that are established in the Intent to Approve. Visible emissions are controlled by opacity standards set in the ITA.

The emissions, in tons per year, will be as follows:
NOx = 12.56, CO = 14.14, VOC = 20.46, HAPs = 1.16

The completed engineering evaluation and air quality impact analysis showed that the proposed project meets the requirements of federal air quality regulations and the State air quality rules. Approval is recommended.

The Lewiston City treatment facility (Lewiston Lagoons) consists of three (3) cell lagoon system. The system was built in 1974 with a total surface area of 16.1 acres. Approximately 850 persons (estimated) are served by the lagoon system. The facility is designed for a flow of 0.11 million gallons per day if operated as a total containment system.

Salt Lake County is a Non-attainment area of the National Ambient Air Quality Standards (NAAQS) for PM10 and SO2. New Source Performance Standards (NSPS), Subpart Dc apply to this source. Title V of the 1990 Clean Air Act does not apply to this source. As a result of the modification, the emissions, in tons per year, will change as follows: PM10 + 0.04, NOx +0.90, SO2 + 0.01, CO + 1.44, VOC + 0.28, and HAPs + 0.03. The changes in emissions will result in the following, in tons per year, potential to emit totals: PM10 = 0.31, NOx = 4.40, SO2 = 0.03, CO = 4.38, VOC = 95.47, HAPs = 0.10.

SOLID AND HAZARDOUS WASTE

Summit County has applied to renew the permit to operate a Class IVb landfill located between Harris & Anderton Canyons, about 1.5 miles northeast of Henefer in Summit County. The Class IVb Construction and Demolition landfill accepts inert (non-combustible non-hazardous) wastes, construction and demolition waste, yard waste, dead animals, and some special wastes such as waste tires and petroleum contaminated soils, as outlined in the permit and permit application. The permit application has been reviewed by the Utah Division of Solid and Hazardous Waste, and a draft permit has been prepared. The Utah Solid Waste Permitting and Management Rules provide for a 30-day public comment period to receive comments on the application and the draft permit before final action by the Executive Secretary of the Utah Solid and Hazardous Waste Control Board.

AIR QUALITY

The University of Utah (U of U) has submitted a Notice of Intent (NOI) to modify Approval Order DAQE-AN0354014-06, operate five existing natural gas boilers, add five emergency generators and remove one emergency backup generator, add a dust collector, one small ethylene oxide sterilization unit and make some changes in hours of operation and opacity for the emergency generators. In addition, U of U will replace two dual fueled boilers (natural gas and coal), Boiler 1 and 2, at Building 303 High Temperature Water Plant with one natural gas fired turbine with waste heat recovery unit (WHRU). Boilers 1 and 2 have heat input rating of 60 MMBtu/hr; Gas turbine is rated at 7.23 MW at site condition and will have maximum heat input of 72.78 MMBtu/hr. WHRU will have maximum heat rate input of 85 MMBtu/hr.

Salt Lake City is a Non-attainment area of the National Ambient Air Quality Standards (NAAQS) for PM10 and SO2, and is a Maintenance area for CO and Ozone.

New Source Performance Standards (NSPS) apply to this source. National Emission Standards for Hazardous Air Pollutants (NESHAP) and Maximum Available Control Technology (MACT) regulations do not apply to this source. Title V of the 1990 Clean Air Act applies to this source. The Title V operating permit for this source shall be amended prior to the operation of the equipment.

The emissions, in tons per year, will change as follows: PM10 (+) 10.16, SO2 = (-) 1.1, NOx (-) 32.2, CO (+) 18.39, VOC (+) 8.5 and (+) 0.33 HAPs (mainly formaldehyde).

The changes in emissions will result in the following, in tons per year, potential to emit totals: PM10 = 27.54, NOx = 160.7, SO2 = 21.17, CO = 185.33, VOC = 20.98 and 4.06 HAPS.

The completed engineering evaluation and air quality impact analysis showed that the proposed project meets the requirements of federal air quality regulations and the State air quality rules. Approval is recommended.

The Division of Solid and Hazardous Waste’s Used Oil Section is proposing changes to the Used Oil Management Rules (R315-15). The purpose is to update requirements for consistency with other Division program rules, provide more clarity, and to include requirements specified in the Used Oil Management Act that were not included in the original rules. In addition, standardized wording for the various financial assurance mechanisms have been requested by the regulated community to improve and streamline the permit application process.

RADIATION CONTROL

The US Environmental Protection Agency (EPA), Region 8, requests comments from the public regarding a proposed Approval for the shredding operation issued to Energy Solutions LLC for processing certain PCB containing wastes for disposal of at the Low Level Radioactive Waste Landfill Cell at its landfill facility in Clive, Utah. The Approval is issued under Section 6(e) of the Toxic Substances Control Act (TSCA) of 1976, Public Law No. 94-469, 15 U.S.C. 2601 et seq., and the Federal PCB Regulations, 40 CFR §§ 761.20(c)(2)(ii).

The comment period will open Monday, October 1, 2007, and close Wednesday October 31, 2007.
